Terms of Use for diarello

Welcome to diarello. These Terms of Use ("Terms") govern your access to and use of the diarello mobile application and the diarello.com website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who We Are

The Service is operated by the diarello team ("we," "us," or "our"). You can reach us at privacy@diarello.com.

2. Eligibility

You must be at least 13 years old to use diarello. If you are between 13 and the age of majority in your country, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf. The Service is not directed at children under 13, and we do not knowingly allow them to register.

3. Your Account

You are responsible for the activity on your account, the security of your sign-in method (email OTP, Sign in with Apple, or Sign in with Google), and for keeping your contact information accurate. You agree not to share your account or let others use it.

4. Acceptable Use

You agree not to:

  • Use the Service to violate any law or the rights of others.
  • Upload or share content that is illegal, abusive, harassing, defamatory, or infringes anyone's intellectual property.
  • Attempt to break, reverse-engineer, scrape, or interfere with the Service.
  • Use the Service to build a competing product or train any machine learning model.
  • Submit content that doesn't belong to you or that you don't have permission to share.

We may suspend or terminate accounts that violate these rules.

5. Your Content

diarello is built around your journal entries, goals, and conversations with our AI features. You own your content. You retain all rights to anything you write in diarello.

By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely to operate the Service for you — for example, to generate your recaps, run AI chat, sync across your devices, and back up your data. We do not use your content to train AI models, sell it, or share it with advertisers.

6. AI Features and Disclaimer

diarello uses third-party AI models to generate recaps, insights, and chat responses based on your content. We may change AI providers from time to time. You understand that:

  • AI output may be inaccurate, incomplete, or misleading.
  • AI output is not professional advice (medical, mental-health, legal, financial, or otherwise) and should not be relied on as such.
  • If you are experiencing a mental-health crisis, please contact a qualified professional or local emergency services.
  • We make no guarantees about the quality, usefulness, or correctness of AI-generated content.

7. Subscriptions, Billing, and Auto-Renewal

diarello is free to download from the App Store. Using the app's features — journal entries, recaps, AI chat, goals, and arc tracking — requires a paid subscription. Subscription plans (currently weekly and yearly, sometimes with introductory offers) and pricing are shown inside the app at the time of purchase.

Subscriptions are sold and billed by Apple through your Apple ID. The following terms apply to all auto-renewing subscriptions in compliance with Apple's requirements:

  • Length of the subscription: the duration of the plan you selected (for example, weekly, yearly, or yearly with introductory pricing).
  • Auto-renewal: your subscription will automatically renew at the end of each period at the then-current price unless you cancel at least 24 hours before the end of the current period.
  • Charging: payment is charged to your Apple ID at confirmation of purchase and again at the start of each renewal period.
  • Free trials and introductory offers: if a free trial or discounted introductory period is offered, any unused portion is forfeited when you purchase a subscription. The trial automatically converts to a paid subscription unless you cancel before it ends.
  • Managing or cancelling: you can manage or cancel your subscription at any time in Settings → Apple ID → Subscriptions on your device. Deleting the diarello app does not cancel your subscription.

8. Refunds

All payments go through Apple. Refund requests are handled by Apple, not by us. You can request a refund at https://reportaproblem.apple.com. We are unable to issue refunds directly.

9. Intellectual Property

The Service, its design, software, and content (excluding your own content) are owned by us or our licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, or redistribute any part of the Service without our written permission.

10. Third-Party Services

The Service relies on third-party providers, including AI model providers (for AI features), RevenueCat (for subscription management), Resend (for email), and Apple (for distribution and payments). Your use of the Service is also subject to their applicable terms.

11. Termination

You may stop using the Service at any time and delete your account in Settings → Account → Delete Account inside the app. We may suspend or terminate your access if you violate these Terms or if we are required to by law. On termination, your right to use the Service ends, but sections that by their nature should survive (for example, sections 5, 6, 9, 12, 13, and 14) will continue to apply.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any data will not be lost.

13. Limitation of Liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim, or (b) USD 50.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, demand, or damage (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email and update the "Effective Date" above. Continued use of the Service after changes take effect means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of Lithuania, without regard to its conflict-of-laws rules. Any disputes arising under these Terms will be resolved in the competent courts of Lithuania, except where mandatory consumer-protection law in your country of residence requires otherwise.
